Terms of Service

These Terms of Service (“Terms”) are an agreement between you and NewCulture Consulting(“we,” “us,” or “our”). They govern your use of our website at newculture.co and the NewCulture Marketing Hub— our platform for connecting, monitoring, and managing your marketing accounts (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Using Our Website
Our website, including the blog, guides, and free resources, is provided for general information and education. You may browse, read, and share links to our content. You may not copy, republish, sell, or redistribute our content without our written permission.
You agree not to use the Services in any way that is unlawful, that interferes with their operation, or that attempts to gain unauthorized access to our systems or the accounts of others.
Purchases & Digital Products
When you purchase a digital product or service from us, payment is handled by our third-party payment processor. Prices are shown at checkout, and refunds are handled according to our Return Policy. Digital products are licensed for your personal or internal business use and may not be resold or redistributed.
The Marketing Hub
The Marketing Hub lets you connect your marketing and analytics accounts in one place so we can review performance, surface insights, and — where you authorize it — manage campaigns and profiles on your behalf.
To use the Marketing Hub, you must:
- Be at least 18 years old and able to enter a binding agreement
- Provide accurate account information and keep your login credentials secure
- Only connect accounts you own or are authorized to manage
- Use the platform in compliance with these Terms and with the terms of each connected platform
You are responsible for all activity that happens under your account. If you believe your account has been compromised, contact us immediately.
Connected Third-Party Accounts
The Marketing Hub supports connections to the following third-party services:
- Google Search Console— search performance, indexing, and site health data
- Google Analytics— website traffic and audience data
- Google Ads— campaign performance and, where authorized, campaign management
- Google Business Profile— business listing information, reviews, and local performance data
- Facebook (Meta)— page insights, audience data, and, where authorized, content publishing and ad management
- Instagram— profile and content insights and, where authorized, content publishing
- TikTok— account and content performance data and, where authorized, content publishing
- Pinterest— profile and pin analytics and, where authorized, content publishing
When you connect an account, you grant us permission to access that account through the platform’s official API, limited to the scopes you approve during the connection process. We use that access only to provide the Services — to retrieve your data, display it to you, generate reports and recommendations, and take actions you have explicitly authorized. We never access connected accounts for any other purpose, and we do not sell data obtained from connected accounts.
By connecting an account, you represent that you own it or have the authority to grant us access, and you agree to comply with the terms of the platform you are connecting, including the Google APIs Terms of Service, Meta Terms of Service, TikTok Terms of Service, and Pinterest Terms of Service.
Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
You can disconnect any account at any time from within the Marketing Hub, or by revoking our access directly in the platform’s security settings (for example, your Google Account permissions, Meta Business Integrations, or TikTok and Pinterest app settings). Disconnecting an account stops future data access; see our Privacy Policy for how previously retrieved data is handled and deleted.
Third-Party Platforms
Google, Meta, Facebook, Instagram, TikTok, and Pinterest are independent platforms with their own terms, policies, and availability. We are not affiliated with, endorsed by, or sponsored by any of them. We are not responsible for changes they make to their APIs, features, or policies, for outages of their services, or for actions they take on your accounts. If a platform limits or removes API access, the related Marketing Hub features may stop working, and that is not a breach of these Terms.
Authorized Actions on Your Behalf
Some Marketing Hub features let us take actions in your connected accounts — such as publishing content, updating your business profile, or adjusting ad campaigns. We take these actions only with your authorization, and you remain responsible for the content and campaigns run through your accounts, including compliance with each platform’s advertising and content policies and any advertising costs you incur with the platform.
Intellectual Property
The Services, including our content, branding, software, and design, belong to NewCulture Consultingor our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Services for your own business purposes while these Terms are in effect. Your data remains yours — connecting an account does not transfer ownership of your data to us.
Privacy
How we collect, use, store, and delete your information — including data from connected accounts — is described in our Privacy Policy, which is part of these Terms.
Disclaimers
The Services are provided “as is” and “as available.” Marketing involves factors outside anyone’s control, and we do not guarantee specific results — including search rankings, traffic levels, ad performance, or revenue. Insights and recommendations in the Marketing Hub are based on the data available from your connected accounts and are provided for your consideration, not as a guarantee of outcomes. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
Limitation of Liability
To the fullest extent permitted by law, NewCulture Consulting will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Services. Our total liability for any claim related to the Services is limited to the amount you paid us for the Services in the twelve months before the claim arose.
Termination
You may stop using the Services and disconnect your accounts at any time. We may suspend or terminate your access to the Marketing Hub if you violate these Terms, misuse a connected platform, or create risk for us or others. On termination, we will revoke our access to your connected accounts and handle your data as described in our Privacy Policy.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date, and material changes to the Marketing Hub terms will be communicated to active users. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes will be resolved in the state or federal courts located in North Carolina.
